Christine Brown's custody battle against Kody Brown is being described as a “significant custody battle.”
Christine BrownChild support lawsuit against ex Kody Brown has been classified as a Track 3 “significant custody dispute,” In Touch can confirm.
The “Sister Wives” stars, who split in 2021, appeared virtually in court on Dec. 18 and completed their revelations, according to court documents obtained by In Touch. The filing said the court classified the lawsuit as a Level 1 and Level 3 case.
While the Utah State Court defines Track 1 as a “standard” dispute, Track 3 is considered a “significant custody dispute track.”
“This category includes cases involving significant custody disputes, including custody disputes involving allegations of child abuse or domestic violence,” according to the Utah State Court.
During their meeting, scheduled for May 21, 2025, Christine, 52, and Kody, 55, will discuss “whether a custody review is necessary” and “whether the appointment of a private guardian ad litem is necessary, and if so, the Scope of the order and cost distribution.”
Christine and Kody Brown's lawsuit is described as a “significant custody dispute.”
Christine sued Kody on September 16 for child support and custody of their 14-year-old daughter Truely. In the statement of claim obtained by In Touch, Christine filed for paternity of her daughter and shared that Kody was not listed as Truely's father on her birth certificate.
The family matriarch also asked the court to grant a temporary restraining order on her domestic relations, prohibiting both parties from harassing each other in person or virtually, committing domestic violence, or interfering with member care.
In addition to Truely, Kody and Christine share adult children Mycelti, Aspin, Gwendlyn, Ysabel And Paedon.
Kody responded legally to Christine's lawsuit by hiring a Utah attorney who appeared in court on the TLC star's behalf on October 13, according to court documents viewed by In Touch. Ten days later, Kody and his attorney filed a counterclaim, keeping the details secret from the public because the documents remained sealed.
Christine's breakup with Kody was the first of many, like him and Janelle Brown called it terminated in December 2022. His spiritual and formerly legal marriage with Meri Brown ended a month later.
After Christine and Kody went their separate ways, she moved to Utah with Truely.
In October 2022, a source exclusively told In Touch that Kody was “basically not in Truely's life.”
“Kody isn’t going anywhere. Christine has to accommodate Kody. “He’s still paranoid about COVID and everything else,” the insider shared. “So if Christine doesn't choose to take over the transportation and make it happen – and also doesn't put Truely through that stress – then Kody will not have a relationship with Truely. He would have to leave his nest to see his daughter.”
Christine opened up about her decision to move in with Truely on an October 2023 episode of Sister Wives, admitting that it was the “best choice” for her.
“When I lived in Flagstaff, I firmly believed that moving to Utah was the best choice for me and Truely,” Christine said during the episode, which was filmed before the big move. “I knew I was taking Truely away from her father. I felt like the best way to maintain Truely's relationship with Kody was to move her away from him.”
For his part, Kody revealed during a confessional that he was “disgusted” by Christine’s actions. However, she claimed he wasn't there when they lived in Flagstaff, Arizona.
“Let’s just say we lived [in Flagstaff] for 800 days. He went hiking with us once. He went kayaking with us twice and once he didn't even get in the water,” Christine explained on the Sister Wives episode. “This is the third time he has gone with us. Three out of 800.”
