Scott Stapp, the former lead actor of CREED, has lost custody of his three children and the right to enter his home. Jaclyn, his soon-to-be ex-wife, is trying to have him involuntarily committed for 60 days. According to TMZ, Jaclyn says Stapp has been doing a variety of drugs, including coke, weed and meth. You may have seen many homemade videos of him online.

We spoke with Kaine Fisher, local attorney and chair of the Family Law Department at Rose Law Group, to ask him to comment on Stapp's mental and physical condition and how it will affect his current and future relationships with his family.

“I cannot speculate whether Stapp is being investigated by authorities for crimes related to his alleged drug use and could therefore soon be arrested and possibly incarcerated. The TMZ article does not say. One thing is certain, however: A Florida judge felt Stapp posed a serious safety threat to his three children. For a judge to temporarily grant Stapp's wife sole use of the marital home and award his wife sole legal and physical custody of the children suggests that something serious is going on in the Stapp household. It is a harsh measure that requires solid proof of dangerous behavior by a parent. I suspect these orders came with a requirement that Stapp submit to extensive drug testing.”

“There is still hope for Stapp, however. The beauty of custody decisions is that they can be changed later if Stapp decides to get his act together. I represent many clients who have lost their way at some point. Making things right takes a client who is willing to listen to his attorney, put his pride aside, ask for forgiveness, and do whatever is necessary to prove to the court and his spouse that he has his problem under control. The most important thing is that he gets better. That takes dedication. No doubt Stapp has a long road ahead of him and he will be under scrutiny. I just hope his wife is on his side and does not work against him out of anger, malice, or revenge, because these children need a healthy father in their lives.”
