HC on child custody: Kerala High Court rules that child custody cannot be denied to the mother as she is moving abroad for job opportunities

The Kerala High Court has ruled that custody of the child cannot be denied to his mother just because the woman moves abroad for better job opportunities. The statement was made by a department head comprising A. Muhamed Mustaque and Sophy Thomas while hearing a petition filed by the child’s mother. A family court had rejected the mother’s attempt to take her child to New Zealand. The mother then applied to the Supreme Court for a resolution. According to the Supreme Court, the mother traveled to New Zealand for better job opportunities. Given this, the court ruled that her decision to move to another country should not be used to deny her custody. HC on custody: Mother alone has no right to the child, says Delhi High Court; Orders Shikhar Dhawan’s estranged wife Aesha Mukerji to take their son to India.
