In an exchange of fire during a custody swap in Lehigh Acres on Saturday, one man was shot twice and another charged.
Misael Jose Velez, 20, of Lehigh Acres, has been charged with aggravated assault with no intention of killing or neglecting children after the shooting.
A report from the Lee County Sheriff’s Office said the mother of a female child argued with Velez over the phone on Saturday over custody issues.
She told investigators that when she got home to Velez, there was another argument. She said she saw him holding a black pistol and firing it at a man when the custody swap began.

The man returned fire, according to a sheriff’s office report, and the woman and man got in the car with the child and drove off.
As they were leaving, the man said he was shot in the back and after she dropped the child at the woman’s home, she took them to Lehigh Regional Medical Center. The car had a broken passenger window during the exchange of fire.
The man’s wounds, a thoroughly grazing wound on his back and another wound on his head, were not life threatening.
Detectives found six .40 caliber cartridges and nine 9mm cartridges at the firing range, but no weapon was found. A surveillance camera hard drive was also confiscated.
Velez remains in Lee County Jail on a $ 15,000 bond. His indictment will be on August 17th.
