Mother and father have precedence in custody circumstances

DES MOINES, Iowa (AP) – The Iowa Supreme Court has ruled that parents must be given preferential treatment in regaining custody of their children if other people have cared for the children through guardianship.

In a decision in the case of a single mother and her child’s grandparents, the court on Friday found that parents have a fundamental right to care, custody and control of their children. The court said that in cases where parents seek the return of children and the dissolution of guardianship, the juvenile court must assume that “the best interests of the child are served by reuniting the minor child with his or her parent.”

The reason for the decision was the case of a child of a 16-year-old mother. The child mostly lived with his grandparents, but the mother requested full custody return.
