In one exceptional marital dispute in Gujarat High Court, a woman has challenged an order from the Jamnagar Family Court requiring her husband to pay Rs 45 lakh alimony before their marriage is dissolved.
When the case came to trial, the court took the practical view that the maintenance granted by the family court was sufficient. The court also examined the fact that the man was cohabiting with another woman, from which they had two children.
While hearing the case, Judge Pardiwala said, “Let’s look at it in practical terms. The man has another woman in his life. Their relationship resulted in two children. He is not allowed to legally marry his current partner. But what does your future look like now? Can you live a happy, peaceful life with this man? Because then the second wife and her two children would also be doomed. Rather, you have been awarded a good amount as permanent maintenance that is sufficient. “
The petitioner alleged that she had not contested the maintenance awarded by the court, but that she would not accept the reason for the dissolution of the marriage cited by the Jamnagar Family Court. She claimed that the other woman in her husband’s life was what shook their marriage. The court admitted the appeal and published another hearing on the HC after Diwali vacation. The court has given the petitioner the freedom to withdraw the amount deposited by her husband with the court while the appeal is pending.
Meanwhile, the husband’s lawyer alleged that the wife’s arguments in relation to his client’s relationship with another woman had not been proven. In fact, she left him ten years ago in 2011 and has not communicated with him since. In 2013, the husband entered into a relationship with another woman who gave birth to their two children. The petitioner did not care when her father-in-law fell ill. She had filed seven different complaints against the husband, all of which remained.
