New York custody attorneys Martin Mohr and Ethan Steward focus on how a court docket determines a toddler’s finest pursuits
New York City child custody attorneys Martin Mohr and Ethan Steward publish a new article explaining how a court determines a child’s best interests in New York. The attorney mentions that the primary factor in determining which parent will receive physical and/or legal custody of a child in New York is the child’s “best interests.”
According to the NYC Custody Attorneys article, “In a custody battle, precedence is often given to the parent who receives custody first, either as ordered by the court or as part of a voluntary arrangement. For example, if your spouse leaves you for two months and you are raising the child without their presence in your home, the court will take that into account when considering custody and will likely award custody to you rather than to the other parent.”
The attorney explains that if a parent is better able to provide the necessary childcare, that will be taken into account when determining custody. The child’s primary caregiver is also considered during custody. In a relationship where one parent stays at home to care for the child while the other works, the stay-at-home parents are more likely to have custody rights.
Lawyer Martin Mohr says drug abuse will also affect child custody arrangements. The courts will always favor parents who have no history of unhealthy or illegal activities that may affect the children’s health, happiness, and level of care. Emotional stability, mood disorders, and other mental illnesses can also affect the award of custody.
In the article, Attorney Stewards adds that when there is evidence of spousal abuse or child abuse, it reflects badly on the responsible party. In addition to possible criminal charges, the responsible parent is also less likely to gain custody.
“If one parent is unemployed and does not have the financial means to provide stable housing and the other parent is stable and has adequate housing, the latter parent is more likely to get custody. Courts always try to keep children together, so if one or more children already live with one parent, the court is more likely to award custody to that parent,” says the custody attorney.
Finally, the attorney emphasizes the importance of having a qualified child support attorney when dealing with matters such as custody and handling of children. An experienced attorney can help parents understand their roles and responsibilities in the divorce and help them reach a favorable settlement.
