A PIL has been submitted to the Supreme Court seeking “gender and religiously neutral” uniform maintenance and support reasons for all citizens that conform to the spirit of the constitution and international conventions.
The plea in law tabled by BJP leader and lawyer Ashwini Kumar Upadhyay calls on the Union’s ministries of interior and justice to take appropriate action to eliminate the prevailing anomalies in terms of alimony and maintenance for all citizens without discrimination on the basis of religion unify race, occupation, gender, or place of birth.
The petition states that, despite the eloquent provisions in the constitution, the center did not create any gender-neutral, religion-neutral uniform maintenance and support reasons for all citizens. “Livelihoods are the only source of livelihood, so discrimination based on religion, race, caste, gender or place of birth is a direct attack on the right to life, liberty and dignity guaranteed under Article 21 of the Constitution. “it said.
“Even after 73 years of independence and 70 years of India as a socialist secular democratic republic, laws regarding maintenance and support are not only complex and cumbersome, but also go against the constitutional mandate to be equal, rational and fair,” it said. – PTI
