Pune: A woman filed a petition in the court seeking maintenance from her unemployed husband under the Domestic Violence Act. She is an IT expert. Her father gave her an apartment where her husband and in-laws live. Her husband doesn't work. She takes care of her son and herself. Her husband and family members harass her mentally and physically.
The court said that even though her husband was unemployed, he could not shirk his responsibility for caring for his wife and son. He has to pay them maintenance of Rs 10,000 a month. JFMC, Pimpri, RM Giri have recently issued the policy.
Rahul and Leena (names changed) got married in 2018. Leena is an employee of an IT company. The complainant was under the impression that her husband had been trading stocks since their marriage. Two years after marriage, they were blessed with a baby boy. Your husband doesn't earn money for his wife or his son. The complainant's father gave her an apartment. However, her husband and in-laws started harassing her so that they could transfer the property to her. Therefore, the woman filed an application under the Domestic Violence Act in the court through her lawyer Adv Prasad Viraj Nikam.
Adv Nikam argued on behalf of the complainant: “The court is of the view that the husband of the complainant cannot shirk his responsibility to take care of his wife and son.” Not caring for his wife, insulting her or Not giving her food is tantamount to domestic violence.”
The court upheld Adv Nikam's arguments and approved the maintenance application. Adv Nikam was supported by Adv Mansoor Tamboli, Adv Tanmay Dev and Adv Shubham Bobade.
