Harrisburg, Pa.-in framework of his ongoing attorney for 50-50 custody about children, rep. Jamie Flick recently defended a closely rejected change in legislation to update the guidelines for custody sport in Pennsylvania.
The house has stopped the vote on HB 378, which recommended the update and fusion of the decisive factors in custody matters, including cooperation and conflicts between parties. The willingness and ability of a party to prioritize the needs of a child through adequate care; Stability and continuity for the child; And employment plans and the ability to either take care of the child or to make suitable childcare agreements.
Rep. Flicks Change of the legislation would have made the assumption that 50-50 custody is in the best interest of the child as long as both parents are suitable for care. In addition, it removes the 19 custody factors of 19 custody and replaces them by considering the abuse committed by a party in the past. The level of conflict between parties; and willingness and ability to cooperate. The change also requires that a judge submit a written declaration for the decision if 50-50 custody is rejected.
The house voted against Flick's change with a 103-99 vote, although it received non-partisan support.
“The victory was that we brought it to the ground for a coordination, which has not yet happened,” said Rep. Flick, who has been optimistic about the support for the change so far.
This change application is very personal. According to Rep. Flick, a judge decided in a few minutes that his children could only see him every other weekend. The verdict seemed nonsensical, especially since Flick was classified as a capable dish that was appointed in Lycoming County, was a present and a committed father and received two children from New York as part of the Fresh Air program.
“I felt that the dishes kidnapped my children. I supported so hard to get custody that I had a stroke,” said Flick.
This terrible moment in court inspired Flick to run for an office and try to repair the family court system. According to the US Census Bureau, mothers receive custody in 80% of all custody cases. In Pennsylvania, fathers are awarded an average of 28.2% of parental leave.
Rep. Flick is of the opinion that the standard in a divorce should be 50-50, unless a parent is classified as unsuitable, and if a parent receives less than 50-50 custody, you should be informed about the reason for this decision in a written order.
“It is generally recognized that fathers play an important role in the development and maturation of children,” said Flick. “Without shared parenthood, children abuse drugs or alcohol twice as often, who are twice as likely to struggle four times more often with emotional or behavioral problems and become seven times more youthful parents. Even more alarming, 63% of the suicide of young people and 71% of school leavers come from children who have no access to parents.”
Flick has traveled through the country to meet other state legislators about this draft law and adopted in four countries. Similar legislative templates that were adopted in the Kentucky representative with a 97: 0 votes, 64: 0 in the South Dakota representative, 105: 7 in the House of Representatives of Florida and 114: 9 in the House of Representatives of Missouri.
Flick said that he is constantly getting positive feedback via e -mail and text from hundreds of hundreds of residents, both in his district and after he addressed groups on his travels.
“This is the public legislation for electoral groups, but unpopular in court, as custody fights generate a lot of money for the courts and lawyers who argue the cases,” said Flick.
