A Rosemount woman has been sentenced to nearly four years in prison for stabbing her daughter’s father in the neck during a custody battle.

Lisa Dawn Oliver, 45, stabbed the man outside his Apple Valley home on Oct. 23, leaving him with a deep wound near his carotid artery, prosecutors said. A Dakota County jury convicted Oliver on February 3 of both first-degree and second-degree assault, but willfully acquitted her of attempted second-degree murder. She was sentenced on Wednesday.
According to the criminal complaint, officers responded just before 9 p.m. and found the man with a throat wound that appeared to be deep and 2½ inches long. He said, “He didn’t want to die.”
He gave a statement to police at the hospital, saying Oliver dropped her daughter off at his home around 8pm. He said the girl wanted to go back to her mother, but he told her she couldn’t.
He said Oliver showed up in a rideshare a short time later. He said he changed his mind and wanted to let their daughter go, but Oliver went to his house “to have a fight with him,” the complaint says. He said he told her daughter to get in the rideshare.
He said Oliver wanted to take her daughter and told her it was fine that night and “she couldn’t make a habit of it,” the complaint reads. Oliver returned to the rideshare where her daughter was waiting.
Later, he said, he looked outside through his blinds and saw that the ride hadn’t left yet. He said he went out to smoke a cigarette and Oliver walked up to him, kicked him in the face and started pushing him. He said she was upset that he had sole custody of their daughter.
“The victim said before he knew it she pushed him and he felt something go over his throat and blood spurt out of his throat,” the complaint reads.
Neighbors told police they heard an argument escalating. A neighbor heard a woman’s voice saying, “I’m going to kill you. I’m going to stab you,” the complaint reads.
Oliver’s roommate told police she spoke to Oliver and she admitted to the stabbing and also said she was hiding in a nearby field.
Oliver’s presumed sentence ranged from 37 to 51½ months. Her attorney pleaded for a suspended sentence and told Dakota County District Judge Michael Mayer Wednesday that she had been dealing with her mental and chemical health through prison programs.
Mayer rejected the application for dispositional departure and sentenced Oliver to 45 months in prison. You are already counted 167 days in custody.
