San Francisco Sheriff's GPS tracking program divides 9th District.

A challenge to the San Francisco sheriff's practice of sharing GPS location data of defendants released from custody before their trial appeared to divide a three-judge panel of a U.S. appeals court during oral arguments Tuesday.

The city wants to overturn a district court injunction blocking in court the portion of the sheriff's electronic surveillance program that allows the sheriff to share location data without a warrant to other law enforcement agencies for separate criminal investigations.

The San Francisco Superior Court decides whether defendants can be released before trial and whether they can be allowed to attend the sheriff's hearing.
