Texas man shoots his companion’s ex in custody battle: video

A Texas man fatally shot and killed his partner’s ex-husband during a bitter custody battle, which worried video shows.

Cell phone footage released Tuesday by a lawyer for Chad Read’s widow’s widow shows the fatal confrontation between the 54-year-old victim and Kyle Carruth outside his Lubbock home on November 5, KCBD reported.

The clip shows Chad Read arguing with his ex-wife Christina before Carruth comes out of his house with a rifle and sets off the deadly confrontation on the porch.

Carruth’s attorney insists the shooting was self-defense, the Lubbock Avalanche-Journal reported.

Read’s widow Jennifer is seeking custody of her late husband’s two boys, 9 and 14, as she believes Christina Read and Kyle Carruth want to get married as soon as possible, according to the report.

According to the newspaper, there were no charges or arrests in the fatal shots until Friday. The shooter has been listed as a suspect in police reports but has not been publicly identified by police.

But civil court records identified the shooter as Carruth, a land developer and estranged husband of Anne-Marie Carruth, a judge in Counties Lubbock and Crosby, according to the newspaper.

Anne-Marie Carruth said on an affidavit that she was told that Carruth was being investigated into the killing of the father of his girlfriend’s children after Read tried to pick them up at Carruth’s house.

A Jennifer Read attorney then released the footage of the November 5 shooting Wednesday, saying it and an accompanying affidavit “speak for itself,” KCBD reported.

“I am the stepmother of the children who are the subject of this lawsuit,” read Jennifer Read’s affidavit. “The children’s mother, Christina Read, has endangered the physical health and emotional well-being of the children by allowing them to be in the presence of the man who murdered their father, Chad Read.”

Christina Read and Kyle Carruth had an “ongoing affair” despite being married, Jennifer Read said in her affidavit.

Carruth’s attorney said he merely defended himself during the “justified murder” while citing the so-called Castle Doctrine of Texas, which allows the judicious use of lethal force against intruders, KLBK reported.

“All Texans are legally allowed to carry a firearm to protect themselves, their property and their business,” lawyer David Guinn told the broadcaster. “When Kyle did that, Chad Read walked up to him.”

Read also threatened to take Carruth’s rifle, Guinn said.

“And immediately he tried to take the gun away from Kyle,” the lawyer continued. “He was there [powerful] enough to throw Kyle 180 degrees onto Kyle’s terrace. “

“He lifted his left leg and continued his advance on Kyle, threatening him and posing an imminent threat,” Guinn continued. “Kyle answered. This is a justified murder. “
