Unemployed ex-husband wants month-to-month alimony funds; Excessive Courtroom to Lecturers – INDIA – GENERAL
MUMBAI: Mumbai High Court has ordered a teacher to pay child support to her ex-husband. The Supreme Court upheld the order of a district court in Nanded, Maharashtra.
The court issued the order on February 26. Judge Bharti Dangre of the Aurangabad Bench of the High Court upheld orders issued by local courts in 2017 and 2019.
The civil court ordered the woman to pay her ex-husband provisional alimony of Rs 3,000. It also asked the headmaster to deduct 5,000 rupees from the woman’s salary every month and hand the amount over to the court.
Two years after the divorce, the ex-husband had gone to the local court to seek permanent alimony. But the woman, who claimed she divorced her husband in 2015, defied the lower court’s order. The woman’s attorney also argued that neither party has the right to claim alimony once the divorce has been granted. However, the man’s lawyer argued that there are no restrictions on claiming alimony under Hindu marriage law. The woman’s ex-husband told the court that he had no source of income and could not go to work because of health problems. He claimed he paid for the girl’s education after marriage and needed alimony. In doing so, Judge Dangre upheld the lower court’s order that gave the ex-husband the right to claim maintenance under Sections 24 and 25 of the Hindu Marriage Act.
