An Ekiti customary court in Ikole-Ekiti, Ekiti state, has dissolved a seven-year-old marriage between Ms Dolapo Ayegbusi and her husband, Mr Sunday Emmanuel.

According to the Nigeria News Agency (NAN), the court president, Mr. Moshood Balogun, dissolved their marriage due to constant arguments, lack of care and calm, and danger to their lives.

He explained that the relationship between the petitioner and the respondent could only be described as mere coexistence, since there was nothing the court could dissolve.

Balogun therefore ruled that there was no marriage between the petitioner and the defendant and ordered the two parties to go their separate ways.

He gave the petitioner custody of her two children, for whom the best interests and well-being of their children would be paramount.

The President of the Court ordered the defendant to pay N10,000 each month as a maintenance allowance to the petitioner for the maintenance of their children.

He ruled that the money should be paid regularly on or before the 5th day of each new month.

Earlier, the 24-year-old petitioner told the court that she filed the petition because of the constant beating and abuse she was subjected to by the defendant.

She said the defendant always accused her of committing adultery and would hit her for any minor disagreement.

Ayegbusi told the court that while she and the defendant were not married, their relationship was blessed with two children.

The petitioner stated that due to the constant beating and lack of care from the defendant, she took her belongings with her two children and left the defendant.

She asked the court to sever her relationship with the defendant so that she could have peace of mind.

The mother of two asked the court to grant her custody of her children as the defendant failed to fulfill his duties to her children.

She urged the court to grant her application for a monthly allowance of N10,000 to support her children.

In his testimony, the 31-year-old defendant denied the allegations that the petitioner had leveled against him.

Samuel admitted that there was no marriage between himself and the petitioner.

He said that he met the petitioner in Ikole-Ekiti in 2014 and that their relationship was blessed with two children.

The defendant agreed to pay the monthly maintenance allowance of N10,000 and also promised to pay the school fees for his children.

Samuel asked the court not to dissolve their relationship as he was still interested in the petitioner.
