TOKYO, Nov. 15 (Jiji Press)–A subcommittee of a panel of Japan’s Justice Ministry on Tuesday put together a draft proposal to give divorced parents joint custody of their children.
The Subcommittee on Family Law of the Legislative Council, which advises the Minister of Justice, proposed the introduction of joint custody as an option in the interim draft. The panel is expected to solicit public comments on the matter beginning next month and reflect them in its final proposal.
Current Civil Code gives both parents joint custody of their children when married, but sole custody to one parent after a divorce.
The interim draft provides for both the introduction of joint custody and the retention of the sole custody arrangement for divorced parents.
The draft also offers options for introducing joint child custody, allowing it as a standard rule or by way of exception under certain conditions, such as an agreement between parents.
