‘Help me get my children again’: Nairobi father in custody case appeals to William Ruto

  • The father-of-three accused a judge of giving custody of his five-year-old daughter and nine-month-old twins to people he was not related to
  • He urged President William Ruto to intervene and help him access justice since he cannot see his children
  • The former chief prosecutor had ordered the arrest and prosecution of seven people who took his children from him shortly after his wife took her own life

A father whose three children were allegedly kidnapped and handed over to a Mombasa businessman in a contentious custody battle is calling on President William Ruto to step in and return them.

Nakesh Harji, who was joined by religious leaders of all faiths at the Milimani Courts, vowed to camp out at the Kenya High Court until the President steps in and help him get his children back.

“Mr. President, you are a hustler like me and you can understand my need. If I don’t get my kids back I will wear a mattress and sleep on the Supreme Court until my rights are granted. People use money to kidnap me and can even boldly say I can’t do anything to them because they own the government,” Harji said.

In court documents in the case, Harji said he lived with his late wife, Vanita Nekish Senghani, after they married around 2017.

Senghani died on April 3, 2022 in a suicide incident, after which her three children were “violently abducted” by two suspects; Lali and his wife Hirani according to the court.

Harji was held in custody for about a month because of his wife, who was found hanged in her bedroom.

He was then acquitted of all charges, but Lali and his wife took the children away and filed a motion for a custody order in Tononoka Court to retain the children.

Mombasa Principal Magistrate Viola Yator granted them custody over Harji’s dispute that the parties granted custody were not related to them.

Harji told the court that he was the children’s only surviving parent and that the strangers stripped them of custody without his consent.

He also accused prosecutors of not giving him an answer on the status of the persecution of those who took his children from him six months ago after the death of his wife.

Harji told the court that he lives in Nairobi and cannot see his three children.

“I have the ability to take care of my children because I work, and after I give birth to them, it’s my responsibility to raise them,” Harji said.

In July 2022, the Director of Public Prosecution (DPP) ordered police officers to arrest and prosecute seven people linked to the kidnapping of the three children: a daughter, aged five, and twins, aged nine months.

Urvash Kauship, Lalji Hirani, Ratan Daya, Dakish Nilesh Siyani, Mitikisha Vekariyi, Arvid Vekarja and Namrata Manoyi Keshavi Makwana have been arrested and prosecuted for the alleged kidnapping of the three children.

The DPP directed the seven suspects to face charges of conspiracy to commit a crime and kidnapping, and reiterated through JR Meroka, a prosecutor, that there was sufficient evidence to support the charges.

In correspondence authorizing the prosecution of the seven, dated October 13, 2022, the DPP said:

“The acts of July 5, 2022 were criminal hence the following: Urvash Kauship, Lalji Hirani, Ratan Daya, Dakish Nilesh Siyani, Mitikisha Vekariyi, Arvid Vekarja and Namrata Manoyi Keshavi Makwana committed offenses of (1) conspiracy to commit a crime ( 2) kidnapping.”
