A single Bombay High Court judge, GA Sanap, has awarded child support of Rs. 7,000 to a woman and Rs. 7,000 to the child, finding that she must be used to living a “standard lifestyle” given the woman’s background and social status . .
The Supreme Court heard a case where the husband brought an application for review of the Family Court order awarding alimony of Rs 7,000 to the wife and Rs 7,000 to the couple’s child.
The couple married in 2011 and had a daughter in 2012. The woman’s husband and mother-in-law are said to have abused her and she was forced to live with her parents. In 2019, the family court upheld a divorce decree, which was also challenged in the Supreme Court.
The court said the man had not cared for his wife and child since 2012. The court said that although the woman had a job at the pharmacy, she sought shelter at her father’s house and had no source of income.
The bank found that the husband worked for the railway as a clerk and his gross salary was between Rs 45,000 and 46,000 per month, according to the 7th Salary Commission. The man had also admitted that his mother was on a pension and that the younger brother was also employed.
The Supreme Court said the woman was qualified and had a pharmacy degree. The order reads: “Petitioner No. 1 is also a qualified woman. She has a degree in Pharmacy. Because of her background and social status, she must be used to living a standard lifestyle. She has the right to a life commensurate with her qualifications and the position of the accused. The learned judge took all these facts into account when assessing the maintenance.”
In addition, the court said that Rs 7000 was a reasonable alimony given the rise in commodity prices. The order stated: “Against this background, applying all standards and in particular the increase in the price of essential raw materials, the monthly maintenance, valued at Rs 7,000 per month, is fair, reasonable and reasonable.”
