Bangalore: In an important ruling, the Karnataka Supreme Court ruled that an unemployed husband should find a job to support his wife.

At the sentencing hearing on Monday, a single judge, Justice M. Nagaprasanna, said: “It is the man’s duty to provide maintenance to his wife and children. So if he is unemployed, he should find a job, earn it and provide it.”

The chamber dismissed the man’s appeal, which challenged the Mysuru family court’s ruling on the matter. The man’s lawyer had argued that the petitioner was suffering from several illnesses and that he had no permanent job.

He also stated that no matter how hard he struggled, his income would never exceed Rs 15,000 per month and hence he was unable to pay the alimony.

The High Court brushed aside the argument, finding that it was unacceptable that the husband was unable to pay his wife Rs 10,000 a month in compensation. The bank confirmed that he was able to work and had to find one and pay the compensation.

The local family court had ordered compensation of Rs 6,000 for the wife and Rs 4,000 for the child. The bank further pointed out that Rs 10,000 is not a large sum. The man’s argument that he is unable to raise the amount is just an excuse.

The board claimed that the petitioner did not provide a valid document to prove that he was suffering from liver disease and therefore had to pay the compensation.
