TOKYO, Aug. 29 (Jiji Press) – Japan’s Ministry of Justice on Tuesday presented a working draft of talks to allow divorced parents to share custody of their children.
The draft calls for a revision of the current Civil Code, which assigns sole custody to one parent after a divorce, in order to introduce the system of joint custody.
The Department submitted the draft for discussion to the Legislative Council’s Family Law Subcommittee, which advises the Minister of Justice.
The ministry intends to submit a draft law to revise the Civil Code to Parliament early next year.
Under current law, parents without custody often find it difficult to participate in raising children. This situation is thought to result in non-payment of child support and disruption of parent-child interaction.
