Maintenance amounts in accordance with Article 402a Paragraph 1 Book 1 of the Civil Code founded by court orders or agreements are subject to automatic adjustment. This adjustment is based on a percentage set by the Attorney General, a practice commonly referred to as “indexing.”
In a recent development, it was announced by ministerial decree of December 13, 2023 that the Minister of Justice has set the indexation rate for the 2024 calendar year at 2.70%. Consequently, the maintenance amounts will be increased by 2.70% effective January 1, 2024. .
For example, a parent who currently pays or receives 100 guilders in child support per month can do so anticipate an increase of 2 guilders and 70 cents from January 1, 2024. This adjustment is intended to ensure that the financial support provided corresponds to economic changes and the well-being of dependent children is guaranteed.
