Part 1 – Men can now seek maintenance or alimony from their wives

As a result of a landmark decision by the Supreme Court, men in Guyana can now apply to the Supreme Court to have their former wives pay them maintenance and/or alimony if their marriage is dissolved or annulled and/or they are waiting for the marriage to be annulled. Until now, only women could submit such an application.

This new reality is the result of a ruling by the Supreme Court of Guyana in a recent decision in Sam David Aaron's application 2023-HC-DEM-FDA-244. In this case, the court was asked to determine whether Section 14 of the Matrimonial Causes Act, Cap 45:02, Laws of Guyana, which permitted women (as previously written) to apply to a court to order their husbands to pay maintenance or Compelling maintenance violated, in certain circumstances, his fundamental rights enshrined in the Constitution of the Cooperative Republic of Guyana, as the latter only allowed women to seek maintenance and/or maintenance against their husbands.
