'Let her earn': Why the Karnataka HC denied a woman Rs 600,000 a month maintenance | News from India
The Karnataka High Court recently dismissed a woman's plea seeking maintenance of over Rs 600,000 per month. Justice Lalitha Kanneganti rejected the petition on the grounds that “if she wants to spend money, let her earn it.”
During a hearing on Wednesday, the plaintiff's counsel Akarsh Kanade demanded security of Rs 600,000 as monthly maintenance. According to the plaintiff, this amount is required to meet “basic needs” like bangles, necklaces, sandals, watches, etc.
According to the bar association's statement, the court found that she was not responsible for any other family members or children. “Does anyone spend that much? A single woman on herself?”
The plaintiff also stated that her ex-husband wore expensive branded clothes from brands like Calvin Klein which cost around $10,000 per t-shirt, so she was entitled to the same as she only had old clothes to wear. She also complained that due to her husband's negligence, the plaintiff regularly required medical treatment for knee joint pain, fever, etc.
The court found this appeal inappropriate, saying: “If you want an order from the court, I want concrete numbers, not these hundreds of thousands, which I will not give, otherwise I will dismiss your application. Please tell your client.” She also warned the women against “taking advantage of the court's process” and said the case sends “a loud and clear message to all litigants” who believe they can exploit the law.
The plaintiff even tried to lower the alimony amount, to which the court responded, “Your client does not understand this, but you should understand and give her advice. This is not a place for negotiation. You must tell the court your actual expenses. We are giving you one last chance to be reasonable. Otherwise, we will dismiss the motion immediately.”
The court further added that the plaintiff's request could be denied solely on the ground that it was unreasonable.
