Chicago divorce legal professional Russell Knight explains the various kinds of youngster custody in Illinois
Chicago divorce attorney Russell Knight publishes a new article (https://rdklegal.com/what-are-the-different-types-of-child-custody-in-illinois/) detailing the different types of child custody in Illinois explained. The attorney mentions that there are many references to different types of child custody, including sole custody, joint custody, and physical custody. In Illinois, child custody is something that cannot be pigeonholed. Because of this, the Illinois legislature removed the word “custody” entirely from the Illinois Marriage and Dissolution of Marriage Act.
“Parental leave is literally just a schedule for each parent’s time with the children. This schedule is agreed and approved by the Family Court Judge. If the parents can’t agree on the schedule, the family court judge assigns the parents a schedule based on the child’s “best interest,” says the Chicago divorce attorney.
The attorney explains that parental responsibility refers to the decision-making responsibility that both parents will have for the child. There are four categories in which the parents must decide on decision-making responsibility. These categories include education, health, religion, and extracurricular activities.
Attorney Russell Knight adds that if the parents cannot agree who has what responsibility, the family court must apportion that responsibility to each parent. Also, in Illinois, joint custody means that both parents share decision-making and parenting time equally. With joint custody, both parents are expected to communicate and work together in the best interests of their children.
In the article, Attorney Knight also explains that sole custody in Illinois is quite complicated. If a parent wants to limit their child’s exposure to the other parent, they need to have some serious allegations that they can prove. In order to remove a parent from a child’s life, there must be some type of abuse involved.
According to the divorce lawyer, “Realistically, you have sole custody anytime you have your children with you, as long as the decision doesn’t involve one of the four big factors: education, health, religion, or extracurricular activities. When your children are with you, you are practically the only parent.”
Finally, attorney Russell Knight emphasizes the importance of having an experienced divorce attorney when dealing with divorce matters. An experienced lawyer can help the client understand his rights and achieve a favorable outcome in the case.
