An Abu Dhabi resident has dismissed a counterclaim against his ex-wife on appeal.
When the man and his wife separated, the court gave custody of their daughter to the mother. The man then filed a lawsuit against his ex-wife, demanding that her custody be removed for bad behavior and the fact that she was not able to take good care of their child. The woman then filed a counterclaim, but both claims were dismissed.
The man explained that after the two lawsuits were dismissed, his ex-wife filed another lawsuit demanding an increase in alimony payments from Dh7,000 to Dh10,000 per month. She also claimed Dh500,000 for her daughter’s tuition.
The man said these lawsuits were malicious and filed a lawsuit demanding his ex-wife pay him Dh51,000 in compensation.
After hearing all parties, the Abu Dhabi Court of Appeal upheld an earlier ruling by the trial court that dismissed the man’s claim against his ex-wife.
The man was also told to pay his ex-wife’s legal fees.
This case relates to Muslim expats and Emiratis. Currently, divorce and family cases for non-Muslim expats in Abu Dhabi are not handled by the Sharia court.
