Domestic Violence Case | Husband and wife alimony: Husband stays

MUMBAI: Domestic Violence Case | A court in Mumbai has ordered a separated man from his wife to pay his wife an allowance for looking after their three dogs in a domestic violence case. In an injunction from the Metropolitan Magistrate (Bandra Court) Komalsingh Rajput, the man was ordered to pay ₹50,000 a month to his 55-year-old wife and refused her husband’s request that he not pay for the upkeep of his wife’s pet can dogs.

The woman told the court that she married the defendant (a Bengaluru-based businessman) in September 1986. Many years after the marriage, some differences arose and in 2021 her husband sent her to Mumbai. According to the petition, her husband had promised to pay child support and meet her other basic needs. However, the husband did not keep his promise. The woman was physically abused multiple times.

The petition states that the woman has no source of income. She is ill and has health problems. She also has three dogs to take care of. She had applied for a monthly allowance that included a grant to look after her pets. Her husband had petitioned that the pet maintenance subsidy should not be paid and that the subsidy should be reduced. However, the court rejected the petition.

Pets help people lead healthy lives and reduce emotional disturbances caused by relationship conflicts. In this case, the woman indicated that she had health problems and was responsible for three dogs, and was claiming maintenance from her husband, who lives separately.

The judge said: “I do not agree with the argument that there is no need to award remuneration for caring for pets. Pets are part of a cultivated lifestyle. Pets are necessary for a healthy life. They offer mental support to reduce emotional disturbances caused by relationship conflicts. Therefore, this argument of reducing the allowance is not valid.”
