A matter involving an elderly couple was referred to a chamber of the Gujarat High Court after an attempt at conciliation failed and both parties were unable to reach a compromise. The 72-year-old man and the 65-year-old woman have been involved in a divorce case since 2006.
The man is a naturopath. He has filed for divorce and also challenged a family court order awarding his wife alimony of Rs 20,000 a month. The couple have two married children.
The couple married 41 years ago in 1980 according to Hindu rites. Four years after their marriage, the couple fell out. The matter reached Gujarat HC in 2017 after the family court rejected the application of the man seeking divorce and awarded his wife Rs 20,000 in alimony.
During the hearing, the HC asked the couple to resolve the dispute through mediation. However, the mediation did not work. Now the parties will contest the case mainly in the HC.
This is a rare instance where a senior couple has been involved in a divorce case.
According to case details, the dispute began when the woman allegedly left her husband to live apart. She filed a lawsuit for alimony in 1985. However, they later reached a compromise. According to the settlement, the man lived separately in a rented building and paid her monthly maintenance.
The man later claimed that his wife left his home again to live apart and filed a lawsuit against him. He sought a divorce from her alleged cruelty and constant quarrels with him. For her part, she claimed that her husband was involved in a relationship with another woman.
After a decade of litigation, the Family Court dismissed the husband’s claim and awarded the wife monthly child support. The award was contested in the HC. Considering the couple’s age, the HC deemed it appropriate to resolve the matter through mediation and referred the matter to the mediation board. The couple was called to mediation, but the efforts did not lead to a positive result.
