Eldoret protests 50/50 verdict in custody case – Nairobi News

Drama erupted at the Family Court in Eldoret when a woman interrupted an ongoing court hearing to protest a trial judge’s ruling in her child support case.

The angry woman stood up immediately after the verdict gave her sole custody of her two children, aged five and nine months.

Earlier this year, she went to court and asked the Children’s Court to force the man, who is a senior high school principal in Elgeyo-Marakwet County, to provide for all the needs of the two children.

However, the court ruled that the man in question would only pay the minor’s school fees and medical care.

The decision angered the 25-year-old woman and she began screaming in court, claiming the decision was in the man’s favor.

“There is no justice, there is no justice, I have been wronged. How should someone who was impregnated by a man twenty years older than her have to provide two children with food, clothing and other basic needs? “This is corruption,” the woman said screaming in court.

She said it would have been a relief for her if the court forced the man to pay for food and clothing for the children in addition to school fees and gave her at least Sh5,000 a month for other expenses.

Attempts by court guards to remove her were unsuccessful as she continued to scream and threaten to take off all her clothes in the courthouse.

“It is better that I die and not suffer with the children of someone who has placed the burden of caring for his children on me,” the woman said

She once threatened to hand over the children to the man so that he could take sole custody of the minors.

The aggrieved mother argued that her financial situation did not allow her to cope with this responsibility, especially at a time when the cost of living is high.

“This case concerns the children. Where do I get the money to raise the children? To get money for food? I have to look after two children who are still small. Now the question arises: Where will the money come from when they start school?” she posed.

“I rejected the verdict. If he wants, he can apply for custody and take her with him. I do not want that anymore. Let it be 50/50. I already live with the children and have reached my 50 percent in terms of food, rent, clothing and medication. So I take care of all these tasks without him having to do it.”

The tense moment she experienced in court forced a court clerk to intervene and told the woman to appeal if she was unhappy with the verdict.

“Please accept the judgment and read it. If you are still not satisfied, you have the right to appeal,” the clerk told her.

The woman vehemently opposed the appeal council, claiming the entire court process was rigged.

“I won’t apply because the process is ultimately corrupt,” the woman exclaimed.

She continued to express bitter words to the court and insisted that it was high time the minor’s father took responsibility.

“I have taken care of the children, it is high time that their father gets custody. I will pay the fees when they grow up. They are telling me not to leave the court, I will not do so until the public in this court hears my scream,” she added.

Ironically, moments later, the woman left the courthouse premises while being driven by a man she had sued along with her five-year-old minor.
