Elon Musk and Grimes are fighting over custody, and their lawyer tracked Musk to twelve locations to serve court documents

In September of this year, Elon Musk’s ex-girlfriend Grimes accused Musk of not showing her their son. She then demanded that Musk “respond to her lawyer” and that he “completely tear her family apart.” This was followed by an application to a California court “to establish a parental relationship.” And now Musk is reportedly evading serving Grimes’ custody papers.

According to court documents obtained by Business Insider, Grimes’ lawyers attempted to serve the papers on Musk at least 12 times at multiple locations, including Tesla headquarters in San Francisco, the SpaceX launch site in Boca Chica, Texas, and a horse farm in Texas. But the Tesla boss is accused of not having received these papers.

Grimes’ lawyer is pursuing Elon Musk in various locations

According to Insider, one of the first places Grimes’ lawyers tried to support Musk was Tesla’s headquarters in San Francisco. According to court documents, on September 20, 2023, a legal representative went to headquarters and asked to speak to Musk. The attorney was told by a security guard that Musk was not there and was not allowed to leave the papers.

The process server then went to SpaceX headquarters in Hawthorne, California. However, he was again informed by a security guard that Musk was not there and that he was not allowed to leave the papers.

In addition, Grimes’ lawyers have also tried to track down Musk’s private jet, but without success. On September 23, 2023, a process server went to Van Nuys Airport in Los Angeles, where Musk’s private jet was parked. The process server waited at the airport for several hours, but Musk did not arrive.

The process server then went to the Boca Chica launch site in Texas, where SpaceX’s Starlink satellites are launched. However, he once again failed to serve Musk.

On September 27, 2023, a bailiff went to a horse farm in Texas where Musk was reportedly staying. The trial attorney spoke to a woman at the farm who told him that Musk was not there and that he could not leave the papers.

Grimes’ lawyers have also attempted to hold Musk at his home in Bel-Air, California. However, they were unable to gain access to the property.

Grimes’ lawyers have argued that Musk is deliberately trying to avoid serving the custody papers. They have also asked the court to allow them to serve Musk on a substitute basis, meaning the papers would be served on his employees or other representatives.

If the court grants Grimes’ request for alternative service, Musk would be legally obligated to respond to the lawsuit. However, it is unclear when and whether the court will make a decision on this matter.

Musk’s lawyers, however, argued that the Tesla boss was not shirking duty and that Grimes should have continued to try to serve him properly.

How it all began

In September of this year, Grimes asked Musk for custody of her three children. This came after the singer said in a Twitter post that the tech mogul would stop her from seeing her son.

“Tell Shivon to unblock me and tell Elon to let me see my son or please respond to my lawyer,” Grimes wrote in a since-deleted Twitter post, responding to Walter Isaacson, the author of Musk’s recent published biography. She added: “Until this moment I have never been allowed to see a photo of these children, even though the situation has completely torn my family apart.”

Grimes had later apologized to Isaacson and said she wanted to de-escalate the narrative. Shivon Zilis has two children with Musk and is the director of Neuralink.

“I sincerely apologize for responding to Walter like that. As you can imagine, this was a very gut reaction to something that was very difficult for me. Communication about the twins hasn’t been handled particularly well in the past, but I now completely understand what happened and completely forgive the situation. Women are so often pitted against each other. When I talk to Shivon, it’s clear that she’s a great person and we both want the best for our children,” she wrote at the time.

Grimes, officially known as Claire Boucher, gave birth to her and Musk’s firstborn, a son named X Æ A-Xii, in May 2020. In December 2021, the two welcomed a daughter, Exa Dark Sideræl, aka Y, via surrogate. In September of this year, Isaacson’s biography of Musk revealed that the billionaire and Grimes also had a third child, a boy named Techno Mechanicus.
