The Punjab and Haryana High Court has ordered the owner of a Gurugram-based infrastructure company to pay ₹8 Crore maintenance for his wife.

The High Court, comprising Justice Sudhir Singh and Justice Harsh Bunger, upheld the 2018 decision of a family court in Hisar, according to which the owner of the building with an annual turnover of ₹2500 Crore was granted a divorce.

He married the woman in 1995. Due to marital disputes, he filed for divorce in 2015, claiming that the woman had been very rude and quarrelsome towards him and his family since the beginning of the marriage. The wife, on the other hand, denied the allegations and claimed that his success in his venture changed his mind and he started mistreating her in order to get rid of her and remarry.

The court granted the divorce, noting that a marriage that had become increasingly bitter and acrimonious over the years resulted in nothing but cruelty on both sides. “To maintain the facade of this broken marriage would be an injustice to both parties. A marriage that has broken down irretrievably, in our opinion, represents cruelty to both parties, since in such a relationship each party treats the other cruelly,” it said.
It was further observed that the facts of the case clearly show that the marriage between the parties has broken down and the marital bond is beyond saving. “If the divorce decree is set aside, it will mean that they will be forced to continue living together in complete disharmony, mental distress and tension, which amounts to continued cruelty,” the court added. In view of the husband's good financial health, ₹8 Crore maintenance.
