Custody of the child
The Supreme Court recently allowed a father in a custody battle to meet his son at an ashram and a temple in Kerala.
A judge’s bench AS Bopanna And PS Narasimha had on October 3 allowed the father to meet his child at a mall while amending a family court order allowing him to meet his son on the court premises.
On October 31, the court modified its October 3 order and allowed the man to take his son to Sri Mata Amritanandamayi Devi’s Amritapuri Ashram and Padanayarkulangara Temple in Kollam in Kerala.
As permitted earlier, the father can also meet the child at the mall in Kollam.
Such an interim arrangement will remain in place until the family court decides on the custody case, the top court said.
The bench was hearing an appeal against the order of a family court and the order of the Kerala High Court.
While granting certain visitation rights, the family court asked the father to exercise in the courtroom on Sundays between 11:00 a.m. and 4:00 p.m. The Supreme Court upheld the agreement.
However, on October 3, the Supreme Court, while amending the order, said that the environment in which children’s visitation rights are exercised is also important.
“We are of the opinion that repeated visitation rights in the court premises would also not be in the child’s interest, as the environment in which the visitation right is exercised would also be important,” the chamber had stated.
The court finally dismissed the appeal today, October 31, after amending its October 3 order.
The father’s petition in the high court was filed through advocate Sriram Parakkat.
In addition to Parakkat, lawyers Nishe Rajen Shonker, Anu K. Joy, Abraham C. Mathew and Alim Anvar represented the father.
Lawyers Tanya Aggarwal, Padmesh Mishra, Arkaj Kumar and Neelam Singh appeared for the wife.
