Maria Remillard is quoted in Massachusetts Lawyers Weekly: “Court approves delay in reducing husband’s support.”

In a recent court case, a Probate and Family Court judge approved a modification to the husband's support payments due to changed circumstances. The husband and his business partner sold their business, which resulted in the husband taking a pay cut. Massachusetts Lawyers Weekly spoke with Maria Remillard about her stance on the case, including the inconsistencies she believes it creates.

“This holding effectively required this payor to use a portion of his capital gains, dividends and interest income from assets received in a divorce to satisfy the alimony obligation until the receipt of those income ceased,” Remillard said. “Only then did he receive a reduction in his maintenance obligation.” This result does not seem to be compatible with the intent of the Maintenance Reform Act.”
