Nashville doctor challenges federal custody order; could set precedent if successful – 3B Media News

Dr. Scott Wilson filed a lawsuit naming judges and the Tennessee Attorney General in a move that could set a new precedent. He argues that the state law, which is based on long-standing traditional values, is biased against fathers and therefore unconstitutional.

Wilson fathered a child even though he was not married and separated from his daughter's mother after two years. The law stipulated that a child born out of wedlock automatically went into the mother's care in the event of a separation.

Nashville civil rights attorney Wesley Clark said Wilson has not seen his child in more than three months and claims the state's custody laws are sexist.

After a trial, Wilson was granted alternate weekend visitation rights. However, Wilson decided to appeal the ruling and take the matter to federal court.

According to the CDC, nearly 40% of all births in the United States in 2018 were to unmarried women.
