Joe Jonas and Sophie Turner’s divorce took a particularly contentious turn on Thursday when she filed a lawsuit requesting that she and her two daughters be allowed to emigrate to the United Kingdom. While the courts have historically favored mothers in custody cases, the Game of Thrones star reportedly said she faces an uphill battle.
Now legal experts are weighing in on the Hollywood power couple’s court battle and explaining why Jonas could have the “upper hand.” Attorney Neama Rahmani told Us Weekly, “It really comes down to: What’s the home state?” And every state is a little different, but typically the children have lived there for the six months before filing for divorce. In this particular case, the home state appears to be Florida.”
The former duo’s home base was Miami, and it was there that Jonas filed for divorce. However, the children are now in New York City, and that’s where Turner filed her custody battle. On the surface, it may seem like the boy band star has a strong case, but Rahmani believes Turner’s legal team may have a trick up her sleeve that could give her “a chance” at winning. Not only does the 27-year-old actress have to “prove” that the UK was part of her future plans for raising her family, but she also has to embrace her role as primary parent.
“All she has to do is prove that it is in the best interest of the child to remove the children from that home state. This is just a guess, but it does not mean that children have to stay there permanently,” Rahmani shared. If Turner can build an iron shell at this angle, her wish to return to Britain permanently could come true.
