He had disobeyed the court order, stopped paying maintenance to former wife and shifted to Dubai
In a bid to get hold of a man who failed to pay alimony to his estranged wife, the Gujarat High Court has asked its registry to intimate the ministry of external affairs to forward a non-bailable warrant (NBW) against him in Dubai.
The HC had issued the NBW on November 30 last year to arrest the man and produce him in court in response to the contempt of court petition filed by his wife.
The court had asked the man, Nitin, to pay the alimony to his wife Nisha (names changed) during the course of their divorce petition. As per the court order passed on June 22, 2015, Nitin was asked to pay monthly sums of Rs 25,000 to his wife and Rs 10,000 to his son as maintenance. He initially paid the amount but stopped it from 2019 and later shifted to Dubai.
Nisha had filed a petition against him for not obeying the court order. During the hearing, the court had repeatedly asked him to appear before the court, but he did not comply with the order. The court then issued an NBW against him, but it could not be served at that time.
When the petition came up for hearing, the court asked Nitin’s lawyer to furnish details of the outstanding amount but he could not do so. He submitted that his client paid Rs 33 lakh. However, the court was not impressed and asked the MEA to serve him the warrant.
