A man who, as legal guardian, removes his child from the mother’s care should not be charged with kidnapping, the Lahore High Court (LHC) has said.
Judge Ali Zia Bajwa of LHC Bahawalpur Bench said in his ruling on Saturday: “This court upholds the view that the police authorities have no jurisdiction to interfere in matters of a purely family nature, particularly in relation to custody of minors between their parents.
Fathers and mothers cannot prosecute each other for kidnapping their own minor children.”
The court granted the husband’s request for review and reversed an additional order of the district and hearing judge dated January 29 directing the concerned SHO to record his wife’s testimony under Section 154 of the Code of Criminal Procedure (CrPC).
